Texas law requires that all requests for mental health records be made in writing.

To request your records, or your child’s records, please complete our HIPAA-compliant Authorization and submit it through the Clio client portal.


Please include “REQUEST FOR RECORDS” in the subject line and clearly indicate:


  • Which records you are requesting
  • Where the records should be sent and who the intended recipient is (name, address, and/or email)
     


If you do not have access to the Clio portal, you may email your written request and completed Authorization to:

admin@ainslieconsulting.com.


In the subject line, please write “REQUEST FOR RECORDS.”


If records are requested for use in litigation, please include the case name, cause number, and the court where the case is pending in your request.


If you need a Business Records Affidavit, please indicate this in your records request.

Note that there is a $15 fee for a Business Records Affidavit. The affidavit will be provided only after payment has been received.


No. A subpoena alone does not authorize the release of confidential counseling records, billing records, or other protected health information (PHI).

Records may be released only when one of the following is provided:

  • A valid court or administrative order, or
     
  • A signed Authorization from the client or parent confirming consent for release
     

If a client or parent has stated that they do not want records released, a “statement of assurance” will not be accepted. In those cases, a valid Authorization or Court Order is required.


If you are requesting a copy of couples counseling records, family counseling records, or records for a person who is not yourself or your child, state and federal law require that you provide either a Court Order or an Authorization signed by the person (or parent of the person) whose records you are requesting.


Yes. There is a $150 fee for providing copies of records from this practice.

Payment may be made by credit card or through QuickBooks after an invoice is issued. 


Texas law allows records to be released only after payment has been received.


Your comfort and trust are important to us. If you have a concern, we encourage you to contact us so we can try to resolve it together.

If we are unable to resolve your concern to your satisfaction, you have the right to file a complaint with the appropriate oversight agencies.

The Texas Behavioral Health Executive Counsel investigates and prosecutes professional misconduct committed by marriage and family therapists, professional counselors, psychologists, psychological associates, social workers, and licensed specialists in school psychology.


Although not every complaint against or dispute with a licensee involves professional misconduct, the Executive Council will provide you with information about how to file a complaint.
